Terms and Conditions

Welcome to The Agoge Brazilian Jiu-Jitsu, operated by The Agoge Pty Ltd, in Brisbane, Australia. These terms and conditions (the "Agreement") govern your use of our facilities, classes, and services (the "Services") provided by us. Please read this Agreement carefully before joining our gym.

Membership and Fees

a. Membership: By purchasing a membership, you agree to abide by this Agreement and our gym rules and regulations.

b. Fees: You will be required to pay a membership fee, which is non-refundable. Weekly payments will be debited from your nominated account, regardless of class attendance.

c. Minimum Term: Membership is for a minimum term of 3 months, after which it will automatically renew on a monthly basis. You may cancel your membership at any time, provided you give us at least 14 days’ notice before the next payment is due.

d. Pauses: Memberships can be paused for a minimum of 2 weeks and no less, by completing our Pause Form. Payments will be suspended during the pause period.

e. Cancellations: You may cancel your membership at any time, provided you give us at least 14 days’ notice (via cancellation form) before the next payment is due.

Timetable and Classes

a. Timetable: Our timetable is subject to change, and we reserve the right to amend it at any time.

b. Public Holidays: There will be no classes on public holidays.

c. Booking: Classes are subject to capacity limits and must be booked prior to attending. Bookings can be made through our online booking system.

d. Cancellations: If you need to cancel a class booking, you must do so at least 2 hours before the scheduled class time. If you do not cancel within this timeframe, you may be charged a cancellation fee.

Merchandise

a. Availability: Merchandise is subject to availability. We will endeavour to keep our stock levels up to date, but we cannot guarantee the availability of any particular item.

b. Refunds: Merchandise purchases are non-refundable.

Pauses, Changes or Cancellations

a. Form: Any pauses, changes, or cancellations to your membership must be requested by completing our Pause, Change or Cancellation Form.

b. Notice: We require at least 14 days’ notice before your next payment is due to process any changes or cancellations.

Limitation of Liability

a. Exclusions: To the extent permitted by law, we exclude all liability for any loss or damage suffered by you or any third party arising from your use of our gym, equipment, or services.

b. Indemnity: You agree to indemnify us against any claims or liabilities arising from your breach of this Agreement or your use of our gym, equipment, or services.

Miscellaneous

a. Governing Law: This Agreement will be governed by and construed in accordance with the laws of Queensland, Australia.

b. Jurisdiction: Any disputes arising from this Agreement will be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

c. Amendments: We reserve the right to amend this Agreement at any time, and any such amendments will be effective immediately upon posting on our website.
